PAIMI Council Meeting Minutes Via zoom April 18, 2023 Call to Order The meeting was called to order by Vice Chair Lois Shulman at 11:02 am. Mora Wilkevicz MOVED to approve the Agenda and Veronica Ibrahim seconded. AYES: all NAYS: none Motion carried. Approval of the minutes The minutes from January 17, 2023, were presented for approval. Christopher Land MOVED to approve the January 17, 2023, minutes and Trina Tocco seconded. AYES: all NAYS: none Motion carried. Shulman introduced guest speaker, Trisha Zizumbo from Oakland Community Health Network (OCHN) who is presenting on the Crisis Intervention Team (CIT) Training. Ms. Zizumbo is the Director of Training at OCHN and shared information on Law Enforcement and Community: Crisis Intervention Team. A strong partnership between law enforcement, mental health providers, families and individuals is necessary for a community to effectively respond to people experiencing mental health crises. She explained the intense training they provide for law enforcement on different scenarios they may encounter. There is a CIT Conference August 14-16 that DRM and PAIMI Council members are welcome to attend. PAIMI financial update Michele Brand referred to her financial reports stating PAIMI is currently underspent by 8%-9% and explained the line items. There are no issues with the PAIMI grant and no questions were asked. Grievance update Theresa Diebolt reported four grievance forms were requested and sent out since the last council meeting and two grievances have been filed. One grievance is a PAIMI case regarding sexual harassment in a prison and it has been resolved. The other one was related to an individual asking DRM to assist in filing complaints against MDCR (Michigan Department of Civil Rights), MDHHS (Dept. of Health & Human Services), and various health care providers. Michelle Roberts responded to that grievance, and it has been closed. Michelle added that assistance had been provided to the individual however DRM denied representing them in court related to complaints being filed against the entities listed above. Public Comment There were no public comments made. Legislative update Emily Henderson gave an update stating we are in the height of budget season and are seeing appropriations sub-committees post their budget recommendations which will go to full appropriations committees then into a conference committee for details to be worked out. The State must cut approximately $1 billion from what the Governor proposed, and we don’t know what will be included but are hopeful that essential items will not be cut. Emily discussed some bills they are tracking including guardianship and conservatorship along with a few others. MDHHS has been issuing Medicaid policy updates and DRM is following those related to telehealth services, behavioral health services, and long-term care services. A couple state updates include Medicaid dental coverage went into effect April 1st for adult Medicaid recipients and MI Kids Now loan repayment program has opened up to behavioral health providers. Michelle mentioned the electronic visit verification process and Emily confirmed that MDHHS is transitioning to an electronic visit verification (EVV) system which will begin in 2024. It is in coordination with the Federal Cares Act which requires all states to implement the system for Medicaid funded personal care in home health services. The system will allow providers to validate in home visits for Medicaid recipients of date, time, location, and type of personal care or home health care services provided. EVV will clock hours and track the location of caregivers. Litigation update Simon Zagata is the Community and Institutional Rights (CAIR) Team Director gave a litigation update. Simon was a staff attorney and worked on the NGRI (Not Guilty by Reason of Insanity) case prior to his current position. He led the settlement negotiation efforts with the State and stated once individuals face a judge and are found not guilty by reason of insanity, they are sent to the center of forensic psychiatry for evaluation and receive mental health treatment based on their evaluation. We were seeing more restrictive treatment than what was necessary which led to the lawsuit initiated by DRM. Simon shared some data and explained the settlement terms and goals and what they mean. Education update Kris Keranen reminded everyone that she was not at the last meeting because she was in Washington, D.C. at the Supreme Court listening to our argument in the Perez v Sturgis case. The Perez case is about a young man who is deaf and moved here from Mexico with his parents who did not speak English. Perez started at Sturgis schools at the age of nine and his parents believed he was passing his classes and on track to graduate from high school. When Perez was a senior, his parents found out he had not been passing and was not going to graduate because the school had never provided him with language services. DRM took the case in 2016 and started by filing a due process hearing. DRM won the case at the Supreme Court and can now take this case to Federal Court for damages. The case set a precedence across the United States that a person should not have to forego their rights under IDEA through settlement to get immediate relief to be able to access their other rights. The Education Team is trying to hold the Michigan Department of Education accountable for ensuring kids get supports and services they need to stay in school rather than be suspended. Schools are getting very creative about asking kids with challenging behaviors not to come to school. DRM currently has two lawsuits against the Michigan Department of Education. Kris also mentioned her team continues to get calls regarding threats made by kids in school. Old Business 1. Council membership – have all required seats filled and currently have 13 members. 2. Conferences/trainings/initiatives – members were reminded to let Theresa know when they attended any these. 3. Contact information – members can check the PAIMI portal to ensure their information is correct and to let Theresa know of any changes. New Business 1. Conferences/trainings/initiatives – the CIT Conference is August 14-16 and DRM will pay for two members to attend on a first come first served basis. 2. Topics/interests to be discussed at future meetings – some discussion was held about having someone from the Governor’s office speak at one of the future meetings.
