PAIMI Council Meeting Minutes Via zoom January 17, 2023 Call to Order The meeting was called to order by Chair Jackson at 11:04 am. Christopher Land MOVED to approve the Agenda and James Rye seconded. AYES: all NAYS: none Motion carried. Approval of the minutes The minutes from November 15, 2022, were presented for approval. Veronica Ibrahim MOVED to approve the November 15, 2022, minutes and Mora Wilkevicz seconded. AYES: all NAYS: none Motion carried. PAIMI financial update Michele Brand stated the financial report goes to December 31, 2022, and the PAIMI report goes to November 30, 2022. The PAIMI budget was underspent by a couple percent and as always, the only line item that is over is the insurance since we pay for the year all at once. Grievance update Theresa Diebolt reported two grievance forms were requested and sent out since the last council meeting and two grievances have been filed. One grievance is a PAIMI case and Kyle Williams is responding to it. The other is a traumatic brain injury (TBI) case and will be responded to by the end of the month. If the PAIMI grievant is unsatisfied with Kyle’s response and files another grievance, it will then go to Michelle Roberts for a response from her. Public Comment There were no public comments made. Legislative update Emily Henderson gave an update stating Senate Majority Leader, Winnie Brinks, out of Grand Rapids took the gavel in the Senate, and Speaker Joe Tate out of Detroit will be the Leader in the House. They had introductory speeches and introduced their first handful of bills. There is some legislation around repealing the 1931 abortion ban, right to work and around income taxes. We are expecting to see more legislation around gun reform and around chemical restraints. Litigation update Kyle Williams shared we have made substantial progress in the last quarter on the KB lawsuit and moved from representing the seven individual named Plaintiffs to representing the entire class 65-thousand kids with mental illness. As a result, MDHHS has developed and implemented the MI Kids Now program which falls under new administration, The Bureau of Children’s Coordinated Health Policy and Supports. Their website will allow public access to data and resources for class members and their families Statewide and will provide State-level assistance for families trying to access medically necessary mental health and behavioral health services in the community. Another case, Baksh v. Livingston County Community Mental Health, is regarding a young man who has gone without services in the community for a substantial amount of time. Unfortunately, we were unsuccessful at the Circuit Court level after success at the administrative level, however we appealed it, filed briefs and are hopeful for a successful outcome in the higher court. Kyle gave an update on an education case we are working on. The SB case revolves around a student’s ability to challenge failures to provide free and appropriate education and enforce rights under IDEA through the Michigan Department of Education’s complaint system. We are going into mediation and are hopeful that a settlement in this case will have a dramatic impact on the complaint process’ ability to identify and fix some of the issues kids are having in schools. Education update Kris Keranen is not at this meeting as she is in Washington, D.C. watching one of our special education cases being argued in the US Supreme Court. She will give an update at the next meeting. Old Business 1. Council membership – we currently have 14 members. 2. Conferences/trainings/initiatives – members were reminded to let Theresa know when they attended any these. 3. Contact information – let Theresa know of any changes. New Business 1. Conferences/trainings/initiatives – any upcoming Michelle reminded members of the National Disability Rights Network (NDRN) annual conference which will be virtual again this year. It will be held the week of February 27th and registration has not opened yet. DRM will pay one fee for all staff and all Board and Council members to attend. Look for more details coming soon on how to register. 2. Topics/interests to be discussed at future meetings – some discussion was held regarding medical Power of Attorney and Advanced Directives.
